Terms of Service

Welcome to Evertwine. These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "Member," "you," or "your") and Evertwine, LLC, a Wyoming limited liability company ("Evertwine," "we," "us," or "our").

These Terms govern your access to and use of the Evertwine mobile application, curated venue intelligence, and related digital services (collectively, the "Services"). By onboarding, registering an account, or using our Services, you accept these Terms in full. If you do not agree to these Terms, do not download, access, or use the application.

1. The Evertwine Service

Evertwine is an aesthetic-driven discovery platform providing curated intelligence, structural details, and real-time insights on premium luxury venues, nightlife, and restaurants in San Diego, Orange County, Los Angeles, and other select operating markets. We provide digital materials, including but not limited to "Ambience Briefs," "Live Windows," and "Protocol Briefs," strictly for informational and discovery purposes. Evertwine does not own, operate, manage, or control any of the third-party venues listed in our directory.

2. Premium Memberships, Billing, and Lifetime Access

Evertwine offers premium features, elevated tier rewards, and elite platform access through recurring auto-renewing subscriptions as well as a one-time lifetime membership option.

Auto-Renewing Subscriptions & Reminders: If you select a recurring subscription (e.g., monthly or annual plans), payment will be charged to your Apple ID account at confirmation of purchase. The subscription automatically renews unless auto-renew is turned off at least 24 hours prior to the end of the current billing cycle. You will receive a digital reminder notification prior to any auto-renewal charge being processed.

Lifetime Membership (One-Time Purchase): If you select the Evertwine Lifetime Membership, this represents a single, upfront purchase. This is a non-consumable tier that does not auto-renew and requires no future billing.

Subscription Management & Cancellation: You can manage, modify, or cancel your recurring subscription at any time. We guarantee that the process of canceling your subscription will take no longer and require no more steps than your initial signup. You can turn off auto-renewal at any time by navigating to your Apple Account Settings on your device.

Transactions & Refunds: All financial transactions are handled exclusively through and processed by the Apple App Store billing system. Evertwine cannot issue refunds directly; refund requests must be submitted to Apple via reportaproblem.apple.com.

Pricing Changes: Evertwine reserves the right to modify subscription pricing at any time. Any price changes will be communicated to you in advance through the App Store.

3. Assumption of Risk & "The Reality Clause"

Evertwine is a platform for discovery. While we curate with the highest standards, we cannot and do not guarantee your physical experience, entry, or treatment at any venue. Evertwine is not liable for any events occurring while traveling to, attending, patronizing, or leaving a venue, nor are we liable for physical illness, allergic reactions, food poisoning, or bodily injury. By using Evertwine, you explicitly acknowledge that you visit these third-party establishments entirely at your own discretion and risk.

4. Member Access & Verification

Age Requirement (18+): The Services are intended solely for users who are at least eighteen (18) years of age or older.

Access Discretion: Access to Evertwine is a privilege, not a right. Evertwine reserves the right to modify, restrict, suspend, or terminate platform access at our sole discretion.

Account Security: You are responsible for maintaining the security of your login credentials. Sharing your access credentials with unauthorized users is strictly prohibited.

5. Third-Party Venues

These venues operate completely independent of Evertwine, LLC. Any disputes regarding reservations, seating, billing, food quality, or physical safety must be handled directly with the management of the venue itself. While we strive for real-time accuracy, "Live Intel" (hours, protocols, dress codes) is subject to change by the venues without notice.

6. User-Generated Content, Uploads & Code of Conduct

By using the Services, you agree not to post, transmit, or share any content that is unlawful, abusive, harassing, defamatory, or obscene.

No Fake Testimonials: The Evertwine standard relies on absolute authenticity. Members are strictly prohibited from posting fake testimonials, fabricated reviews, or manipulated venue feedback. Any account found uploading inauthentic testimonials will face immediate and permanent termination.

Zero-Tolerance Policy: We enforce a zero-tolerance policy for abusive behavior towards our concierge team, support team, or other members.

7. AI Concierge & Safety Guardrails

Evertwine utilizes artificial intelligence to power aspects of our in-app scouting and concierge services. These AI systems are strictly programmed with safety guardrails. The AI is designed with an explicit "no self-harm" response protocol; it will not generate or engage with prompts encouraging self-harm, and any such inquiries will trigger automated safety responses containing appropriate crisis resources.

8. Location-Based Services

The Services rely on location services provided by your device's operating system (CoreLocation) for curated feeds. Evertwine does not guarantee the accuracy, completeness, or reliability of any location data.

9. Rewards, Points, and Digital Assets

Any points, rankings, badges, or rewards displayed in the Services are promotional digital markers only. They hold no cash value and cannot be redeemed for real-world currency.

These Terms shall be governed by the laws of the State of Wyoming. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Wyoming.
